Limited Engagement Agreement for Preparation of a Self-Prepared Virginia Homestead Deed

This Limited Engagement Agreement (“Agreement”) is between you (“Client,” “you,” or “your”) and The Merna Law Group, P.C. (“MLG,” “we,” “us,” or “our”). It applies when you use VirginiaHomesteadDeed.com (the “Site”) to prepare a Virginia Homestead Deed and describes the specific, limited services included with that order. This Agreement should be read together with our Terms of Use, Privacy Policy, & Purchase Agreement, which also governs your use of the Site.
1. Scope of This Engagement
By submitting your order and the information requested during the Site’s guided process, you engage MLG for the following limited purposes only:
- preparing a Virginia Homestead Deed, valid in form and content under Virginia law, based on the information you provide; and
- providing reliable instructions for (a) recording the deed with the appropriate circuit court, (b) scheduling your exemption hearing, and (c) appearing at that hearing on your own behalf.
This engagement begins when you submit your completed information and payment, and ends when we deliver your completed deed and instructions.
Using the Site’s guided process, including the instructions described above, is a document-preparation and self-help information service. It is not legal advice, does not by itself create an attorney-client relationship, and is not a substitute for independent legal advice about your specific situation. MLG does not represent you in, or appear on your behalf at, any hearing; the instructions in item 2 above are provided so that you can record your deed and represent yourself at your exemption hearing. If, at MLG’s discretion, an attorney contacts you directly to discuss your order or answer a specific question, that direct communication may involve legal advice and is addressed separately in Section 5 below.
1A. Deliverable-Correctness Review
After you submit your order, MLG reviews the generated Homestead Deed and related documents against the information you provided, solely to confirm the deliverable accurately reflects your submitted answers and meets Virginia’s format requirements for recording. This review does not include independent investigation or verification of the facts you provided, does not involve direct contact with you unless MLG identifies a discrepancy that must be resolved before delivery, and does not constitute legal advice about your specific situation.
1B. Included Educational Guide
Your purchase also includes MLG’s “Ultimate Guide to Recovering Your Garnished Money Using a Virginia Homestead Deed,” a general educational resource written by a licensed Virginia attorney. The Guide explains, in general terms, how Virginia’s homestead exemption and garnishment-recovery process typically works. It is provided for general educational purposes only, is not tailored to your specific facts or circumstances, does not constitute legal advice about your situation, and does not expand the scope of this engagement described in Section 1 above.
2. What This Engagement Does Not Include
This engagement is limited to the deed preparation and instructions described in Section 1. It does not include, and MLG is not engaged to provide:
- representation in any court proceeding, or appearing on your behalf at your exemption hearing (Section 1 explains the instructions we do provide so you can appear on your own behalf);
- filing or recording your deed with the circuit court on your behalf (we provide instructions, but you or your designated courier must file it);
- negotiating with any creditor, employer, bank, or their attorney;
- representation in a bankruptcy case or advice on whether to file one;
- legal advice on any matter unrelated to the preparation of this specific deed; or
- any ongoing or future representation after your deed and instructions are delivered.

3. What Our Preparation Relies On
The deed we prepare, and the instructions we provide for recording, scheduling, and appearing at your exemption hearing, are based entirely on the information you enter during the guided process. We do not independently investigate your case, verify the facts you provide, or search court, land, or other public records beyond what is necessary to complete the deed itself.
You are solely responsible for reviewing everything you enter, including names, addresses, case and court information, and dollar amounts, for accuracy and completeness before submitting your order. MLG assumes no liability for any inaccuracy, omission, or error in your deed, recording, hearing date, or hearing outcome that results from information you supplied. Please double-check your entries carefully; our guarantee (see our Disclosures and Money-Back Guarantee pages) does not cover errors caused by incomplete or inaccurate information you provided.
4. Fee
The document preparation service described in Section 1 is included in the price you pay for the service tier you select at checkout. There is no separate or additional fee for the preparation described in this Agreement, apart from any optional add-ons you select at checkout.
5. Confidentiality
We treat the information you submit through the Site as confidential and handle it consistent with our Privacy Policy. Because the guided document-preparation service described in Section 1 does not by itself create an attorney-client relationship, attorney-client privilege does not automatically apply to the information you enter into the questionnaire. If MLG contacts you directly to discuss your order, or you contact MLG directly to ask a legal question, that specific communication may be protected by attorney-client privilege to the extent recognized under Virginia law. 6. No Guarantee of Outcome
The Site’s guided process is designed to produce a deed that meets Virginia’s format and content requirements based on the information you provide. This does not guarantee that a court will grant your claimed exemption, that a creditor will not contest it, or any other outcome of your case. MLG’s responsibility under this Agreement is limited to the accurate preparation of the deed based on the information you supplied.
7. Ending This Engagement
This engagement ends automatically when we deliver your completed deed and filing instructions. You may end it earlier by notifying us before delivery; refunds, if any, are governed by our Money-Back Guarantee.
8. Governing Law
This Agreement is governed by the laws of the Commonwealth of Virginia.
9. Your Acknowledgment
By submitting your order, you acknowledge that you have read and understood this Agreement, and that you agree to the limited scope of services described above.
