THIS WEBSITE MAY BE CONSIDERED LEGAL ADVERTISING UNDER VIRGINIA LAW.
By using the VirginiaHomesteadDeed.com website (the “Site”), you, the user, agree to our Terms of Use and Service and confirm that you understand our Privacy Policy and our AI Disclosure Policy. If you do not agree, please do not use the Site.
The Site is wholly owned and operated by The Merna Law Group, P.C. (“MLG”), a corporation organized under the laws of, and duly licensed to practice law in, the Commonwealth of Virginia. The Site does not offer general legal advice on matters outside the preparation of your Virginia Homestead Deed and is not a substitute for the advice of an attorney regarding your broader legal, financial, or bankruptcy situation.
What the Service Includes
The Site provides a guided process (the “Solution”) through which you can prepare a Virginia Homestead Deed to protect eligible real estate or personal property from a wage garnishment, bank account levy, or judgment creditor, using the specific format Virginia law requires for this type of deed. Every order includes:
- Written instructions for recording the deed with the appropriate circuit court;
- Guidance on setting up your homestead exemption hearing; and
- Guidance on what to expect at, and after, that hearing.
The Solution converts the information you provide into a deed formatted to meet Virginia’s requirements. It does not include reviewing your deed for legal correctness, representing you in court, filing or recording the deed on your behalf, appearing at your exemption hearing, or negotiating with any creditor. You remain responsible for filing or recording your deed and for appearing at any hearing. MLG does not guarantee the outcome of any court proceeding or the actions of any court, clerk, or creditor, and is not responsible for the effect of information you provide that is inaccurate or incomplete.
Our Guarantee
We stand behind our own work. If your Homestead Deed does not work because of an error MLG made in preparing or reviewing it, we will refund the fee you paid for that order, up to the full amount charged. This guarantee does not cover errors or omissions in the information you provide, deadlines you miss, or decisions made by a court, clerk, or creditor. Full terms are available on our Money-Back Guarantee page.
No Attorney-Client Relationship
Communications between you and VirginiaHomesteadDeed.com are governed by our Terms of Use and Service and our Privacy Policy. Using the Site, including submitting your order, does not create an attorney-client relationship or an engagement for legal representation. Communications with the Site are not privileged unless and until you sign a separate engagement agreement with MLG for legal representation. Please do not use the Site to submit confidential, time-sensitive, or privileged information.
Use of AI-Assisted Tools
Some parts of our process use AI-assisted tools to help prepare your draft deed and related materials. AI tools do not make legal determinations or finalize your documents on their own; your completed deed is prepared from the information you provide, and you are responsible for reviewing it for accuracy before filing. See our AI Disclosure Policy for details on how these tools are used and how your information is handled.
